RIGHT OF WITHDRAWAL, RETURNS AND REFUNDS

This policy governs the right of withdrawal, the procedures for returning products and the related refunds for purchases made through the Éditions Ventinove website.

Right of Withdrawal

Pursuant to Articles 52 et seq. of Italian Legislative Decree No. 206 of 6 September 2005 (the “Consumer Code”), Customers who qualify as consumers have the right to withdraw from the purchase contract without having to provide any reason and without incurring any costs other than those provided for by applicable law and specified in this policy.

The right of withdrawal is granted exclusively to natural persons who make a purchase for purposes unrelated to any business, commercial, craft or professional activity they may carry out.

For orders delivered outside the European Union, the specific conditions set out in Article 13 below shall apply. In particular, without prejudice to any mandatory rights granted under applicable law, the acceptance of a return request due to a change of mind relating to a non-EU order is subject to the discretion of Éditions Ventinove.

Time Limit for Exercising the Right of Withdrawal

Where the right of withdrawal provided for by applicable law applies, the Customer may exercise it within 14 days from the day on which the Customer, or a third party designated by the Customer other than the carrier, acquires physical possession of the products.

In the case of a single order comprising several products delivered separately, the period shall run from the day on which the Customer, or the designated third party, acquires physical possession of the last product.

To comply with the withdrawal period, it is sufficient for the Customer to communicate their decision to withdraw before the 14-day period expires.

For orders delivered outside the European Union, the Customer may submit a return request within 14 days of delivery. Unless otherwise required by mandatory provisions of applicable law, such request does not automatically entail acceptance of the return by Éditions Ventinove and will be assessed in accordance with Article 13.

How to Exercise the Right of Withdrawal and Request a Return

To exercise the right of withdrawal, where applicable, or to submit a return request, the Customer must notify Éditions Ventinove of their decision by means of an explicit statement.

The Customer may use the return procedure available on the website:

  • access My Account → Returns and Withdrawals, or use the button available on the relevant order page;

  • choose the type of request, for example withdrawal/return or damaged/non-conforming product;

  • select the products concerned;

  • provide, where required by the procedure, the information useful for processing the request. Providing a reason for the change of mind, where requested, is not a condition for exercising the right of withdrawal in cases where such right is granted by law.

For orders delivered within the European Union, once the communication has been submitted, the Customer will receive an email containing the instructions necessary to return the products.

The direct costs of returning the products shall be borne by the Customer.

For orders delivered outside the European Union, the request will first be assessed by Éditions Ventinove.

Submission of the request by the Customer does not constitute automatic acceptance or authorisation of the return.

Éditions Ventinove will communicate by email whether the request has been accepted or rejected. If accepted, the return conditions, shipping methods, any applicable costs, refund arrangements and any other necessary information will be communicated and handled directly between Éditions Ventinove and the Customer.

The Customer must therefore wait for written confirmation and instructions from Éditions Ventinove before shipping a return relating to a non-EU order.

For non-EU orders as well, all return costs due to a change of mind shall be borne by the Customer.

Return of Products

Where the right of withdrawal provided for by law applies, once the Customer has communicated their decision to withdraw, they must return the products without undue delay and, in any event, within 14 days from the date on which they communicated their decision to withdraw.

The deadline is met if the Customer sends back or returns the products before the 14-day period expires.

Products must be returned in accordance with the instructions provided by Éditions Ventinove.

For orders delivered outside the European Union, the Customer must not ship any product before receiving Éditions Ventinove’s express acceptance of the return request.

If a non-EU return request is accepted, the return must be made exclusively in accordance with the procedures and within the time limits communicated directly by Éditions Ventinove to the Customer.

The Customer is advised to retain all documentation relating to the return until the procedure has been completed and the refund has been issued.

Where the Customer independently uses a shipping service, if permitted by the instructions received, it is recommended to use a trackable shipping method and retain the relevant receipt.

Return Costs

Orders Delivered within the European Union

For orders delivered to an EU Member State, the direct costs of returning products following withdrawal due to a change of mind shall be borne by the Customer.

The Customer will receive the necessary return instructions by email.

Where Éditions Ventinove provides or recommends a specific shipping service, the cost of the return shall in any event remain the responsibility of the Customer and may, where communicated in advance, either be paid directly by the Customer or deducted from the amount of the refund.

Orders Delivered Outside the European Union

For orders delivered to countries outside the European Union, any return due to a change of mind is subject to prior acceptance by Éditions Ventinove in accordance with Article 13.

If accepted, all return costs shall be borne by the Customer.

Éditions Ventinove will communicate directly to the Customer the procedure to be followed for the return.

Any customs duties, taxes, customs clearance fees, import or export charges and any other costs connected with an international return shall be borne by the Customer.

In all cases, the Customer is required to return the products properly packaged and protected, taking all reasonable precautions necessary to prevent damage during transportation.

The provisions of this section concerning return costs due to a change of mind are without prejudice to any rights provided by law in relation to damaged, defective or non-conforming products.

Condition of Returned Products

The Customer is invited to return the products complete with any accessories and, where possible, with the packaging, labels and any other items received together with the product.

The Customer may inspect and handle the product only to the extent necessary to establish its nature, characteristics and functioning, in a manner comparable to what would reasonably be permitted in a retail store.

The absence of or damage to the original packaging does not automatically result in the loss of the right of withdrawal where such right is provided for by law.

However, the Customer is responsible for any reduction in the value of the products resulting from handling beyond what is necessary to establish their nature, characteristics and functioning.

Products must be properly protected and packaged in order to prevent any damage during transportation.

Reduction in the Value of Products

Where a returned product shows signs of use, alterations, damage or other conditions attributable to handling beyond what is necessary to establish its nature, characteristics and functioning, Éditions Ventinove may take into account any resulting reduction in the value of the product in accordance with applicable law.

Any reduction in value will be assessed on the basis of the actual condition of the returned product.

Refunds

Where the right of withdrawal provided for by applicable law has been validly exercised, Éditions Ventinove will refund the Customer the payments received in relation to the products subject to withdrawal in accordance with the law.

The refund will be made without undue delay and in any event within the time limits provided for by applicable law.

Éditions Ventinove may withhold the refund until the products have been received or until the Customer has provided evidence that they have shipped the products back, within the limits permitted by applicable law.

The refund will be made using the same payment method used by the Customer for the original transaction, unless otherwise expressly agreed.

Return costs due to a change of mind shall in all cases remain the responsibility of the Customer, both for EU and non-EU orders.

For orders delivered outside the European Union, the return and related refund, where no mandatory statutory rights apply, will be processed only following prior acceptance of the request by Éditions Ventinove and in accordance with the conditions communicated and agreed directly with the Customer.

Exchanges

Éditions Ventinove does not provide product exchanges.

If the Customer wishes to purchase a different product, variant, colour, model or other item, they must, where the relevant conditions are met, follow the return procedure provided for in this policy and subsequently place a new order.

Availability of the desired product cannot be guaranteed during the return procedure.

Exceptions to the Right of Withdrawal

The right of withdrawal does not apply in the cases expressly provided for by Article 59 of the Consumer Code and by applicable law.

In particular, where such products are available on the website, the right of withdrawal is excluded for the supply of goods made to the Customer’s specifications or clearly personalised.

Any exclusion will apply only where the requirements provided for by law are actually met.

The mere production of an item in limited quantities or the manufacture of an item following an order does not, in itself, exclude the right of withdrawal where the product is not made to measure or clearly personalised for the Customer.

Any other exceptions provided for by Article 59 of the Consumer Code shall also apply where relevant to the type of products sold.

Damaged, Defective or Non-Conforming Products

The return of a damaged, defective or non-conforming product is separate from the exercise of the right of withdrawal due to a change of mind.

In such cases, the Customer may use the dedicated procedure available in their account or on the relevant order page by selecting:

“Damaged / Non-Conforming Product”

The Customer is invited to describe the issue encountered and, where possible, attach photographs of the product and of both the internal and external packaging.

To allow faster verification of any damage occurring during transportation, Éditions Ventinove invites the Customer to report the issue preferably within 48 hours of delivery and to retain both the product and its packaging until the assessment has been completed.

The 48-hour period is intended solely to facilitate the handling of the report and does not limit or reduce the rights granted to consumers under the Legal Guarantee of Conformity.

Once the report has been received, Éditions Ventinove will communicate by email the instructions necessary for processing the request and, where the product must be returned, the relevant return procedures.

The provisions concerning return costs due to a change of mind do not prejudice the rights granted to consumers in relation to defective, damaged or non-conforming products.

Where, under the Legal Guarantee of Conformity or other applicable mandatory legislation, the product must be returned in order for the statutory remedies to be applied, the consumer shall not bear any costs which, under such legislation, are the responsibility of the seller.

Legal Guarantee of Conformity

Products sold to consumers are covered by the Legal Guarantee of Conformity provided for by Articles 128 et seq. of the Consumer Code, where applicable.

For new goods, the legal guarantee lasts for two years from delivery of the product, subject to the conditions provided for by applicable law.

Where a lack of conformity exists, the consumer is entitled to the remedies provided for by law.

In the first instance, where the relevant conditions are met, the consumer may request that the product be brought into conformity through repair or replacement, free of charge.

In the cases provided for by law, the consumer may also be entitled to a proportionate reduction in the price or termination of the contract.

The provisions relating to the right of withdrawal due to a change of mind do not limit, replace or prejudice the rights granted to the Customer under the Legal Guarantee of Conformity or any other applicable mandatory provisions.

Returns That Do Not Meet the Required Conditions

If the returned product does not meet the conditions set out above — for example, if it has been worn, washed, damaged, is missing its original tags or is returned after the applicable deadline — the Seller reserves the right to refuse the return or issue a partial refund, within the limits permitted by applicable law.

Good to Know

Our scarves are hand-printed in small batches using artisanal techniques and, in some cases, with an upcycling approach. Slight variations in colour or minor printing irregularities are characteristics of the handcrafted product and are evidence of its uniqueness, rather than defects.
